Dear Mr. Beck:
NOTICE OF NONCOMPLIANCE
This is formal notice and documentation of noncompliance with the terms and conditions of the June 17, 2003, special use permit issued to the Individuals Assembling For Expressive Activity and Meditation For Peace. The permit is issued for the purpose of conducting a noncommercial group use event on the Evanston Ranger-District, Wasatch-Cache National Forest.
Clause 6 of the special use permit requires that "the holder shall comply with all federal, state, county, and municipal laws, ordinances, and regulations which are applicable to the area or operations covered by this permit." In addition, Secretary of Agriculture's regulations at 36 CFR 251.54(g)(3)(E) requires adherence with applicable State and local public health laws and regulations. As we've discussed several times, public health and safety is my primary concern for this event.
As of June 29, a total of 26 written Incident Reports, 107 written Warning Violation Notices, and 29 written Citations have been issued. These violations are described in more detail in the enclosed spreadsheet. Because these are past events, there is no remedy available. However, to prevent future noncompliance, you should immediately discuss the violations with the group leaders to develop more effective operating procedures that will eliminate future violations. Please understand that a continued and cumulative number of violations may be cause for permit suspension or revocation.
The Forest Service may suspend or revoke this permit in whole or in part for noncompliance with the permit terms and conditions." In addition, the Code of Federal Regulations, at 36 CFR 251.60(a)(2)(i), states: "Revocation or suspension. An authorized officer may revoke or suspend a special use authorization for all other special uses, except an easement... (A) For noncompliance with applicable statutes, regulations, or the terms and conditions of the authorization, (B).............."
The Code of Federal Regulations, at 36 CFR 251.60(e), also requires: "Except when immediate suspension pursuant to paragraph (f) of this section is indicated, the authorized officer shall give the holder written notice of the grounds for suspension or revocation under paragraph (a) of this section and reasonable time to cure any noncompliance, prior to suspension or revocation pursuant to paragraph (a) of this section".
